These terms of use apply to all services and content on digitalartistexchange.com, operated by KunstNetz. The platform serves the presentation and exchange of digital artworks as well as networking among artists. Deviating terms of third parties do not apply unless they are confirmed in writing.

Registration is required to use certain functions. You are obliged to provide complete and truthful information when registering. Your account is not transferable. You are responsible for the confidentiality of your access data. If you suspect misuse, you must inform us immediately by email at info@digitalartistexchange.com.

You confirm that all works you upload (images, texts, videos) were created by you or that you have the necessary usage rights. By uploading, you grant KunstNetz a simple, non-exclusive right to present the works on the platform. Copyright remains with you. Commercial use of third-party content is prohibited without express permission.

It is prohibited to publish content that violates applicable law, glorifies violence, is discriminatory, or contains pornographic material. Spam, phishing, the distribution of malware, and the use of the platform for gambling or fraudulent activities are also prohibited. Violations will result in the immediate suspension of the account.

KunstNetz is fully liable for intent and gross negligence as well as for damages resulting from injury to life, body, or health. For simple negligence, we are only liable in the event of a breach of essential contractual obligations (cardinal obligations). Liability for indirect damages and data loss is excluded to the extent permitted by law. The platform is operated with reasonable care, but without guarantee of uninterrupted availability.

We reserve the right to change these terms at any time with a notice period of 14 days. Significant changes will be communicated to you by email. You can terminate your account at any time without giving reasons. We may block or delete your account if you violate these terms. After termination, your personal data will be deleted in accordance with our privacy policy.

The law of the Republic of Austria applies. The place of jurisdiction for all disputes is the competent court in Vienna. Should any provision of these terms be invalid, the validity of the remaining provisions shall remain unaffected.
